Criminal Penalty and Drug-Quantity Thresholds
Current judicial-caning constraints, murder sentencing branches, section 17 trafficking-presumption quantities, and selected capital drug quantities, kept separate by their distinct legal effect.
Criminal Penalty and Drug-Quantity Thresholds
These tables are retrieval aids, not sentence calculators. No row by itself establishes an offense, guilt, or the sentence in a case. The applicable statute and offense date, charge, conduct, mental element, proved drug identity and quantity, presumptions and rebuttal, defenses, age, role, and case-specific facts must all be considered.
Judicial caning constraints
| Rule | Current position | Important limit |
|---|---|---|
| Sex eligibility | Women cannot be caned | Other punishment and conviction remain unaffected |
| Age eligibility | A man more than 50 years old when caning is inflicted cannot be caned | Age at infliction, not simply age at offense |
| Uncommuted death sentence | A man under an uncommuted death sentence cannot be caned | Commutation changes the analysis |
| Adult aggregate maximum | 24 strokes at one sitting | Applies where multiple sentences would otherwise aggregate above the limit |
| Juvenile aggregate maximum | 10 strokes at one sitting | A light rattan is used |
| Cane diameter | Not more than 1.27 cm | Procedural specification, not sentence length |
| Instalments | Prohibited | A sentence cannot be split into multiple executions |
| Appeal | Execution waits until appeal time expires or appeal is determined | A sentence is not carried out immediately |
| Medical safeguard | Medical officer certifies fitness, attends, and stops caning if unfit | Court may remit or substitute imprisonment for unexecuted caning under the Code |

Murder sentencing branches
| Penal Code murder limb | Sentencing position under section 302 | Retrieval guardrail |
|---|---|---|
| Section 300(a): act done with intention of causing death | Death | Mandatory branch for this murder limb |
| Sections 300(b), (c), or (d) | Death or life imprisonment; if life, liability to caning | Judicial sentencing choice; not automatic death |
Source: Penal Code sections 300–302, current when accessed 8 August 2026. Culpable homicide and other unlawful killings have different elements and penalties; the everyday word “murder” cannot determine the legal charge.
MDA section 17 trafficking presumptions
Possession of more than the quantity shown creates a rebuttable presumption that the person possessed the drug for trafficking. It is not a capital threshold.
| Controlled drug or combination | More than |
|---|---|
| Opium | 100 g |
| Morphine | 3 g |
| Diamorphine | 2 g |
| Cannabis | 15 g |
| Cannabis mixture | 30 g |
| Cannabis resin | 10 g |
| Cocaine | 3 g |
| Methamphetamine | 25 g |
| Ketamine | 113 g |
| Specified MDMA-like drug or combination covered by section 17 | 10 g |
Source: Misuse of Drugs Act section 17, current when accessed 8 August 2026. The statutory wording controls which MDMA-related substances and combinations fall within the final row; use the Act rather than expanding the shorthand.
Selected capital drug quantities
| Conduct and controlled drug | Quantity described by CNB | Legal effect stated by source |
|---|---|---|
| Import or export of diamorphine | More than 15 g | May face the death penalty |
| Import or export of methamphetamine | More than 250 g | May face the death penalty |
| Import or export of cannabis | More than 500 g | May face the death penalty |
Source: CNB joint release on a Tuas Checkpoint seizure, accessed 8 August 2026. This is a selected, non-exhaustive list, not all capital offenses or drugs. “More than” must not be changed to “at least.” Diamorphine quantity refers to the controlled drug established through analysis, not the gross weight of a package or powder. The section 33B sentencing alternatives and all offense elements remain separate questions.
